Terms of Use for Vivoim: AI Video & Image Generator

1. Acceptance of Terms

By accessing or using Vivoim: AI Video & Image Generator ("the App", "the Service"), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you must not use the Service.

2. Description of Service

Vivoim is an AI-powered creative platform that enables users to generate videos and images using advanced artificial intelligence. The Service includes:

  • Text-to-Video: Generate cinematic videos from text descriptions using Grok Video AI
  • Image-to-Video: Animate static photos into dynamic videos using Grok Video AI
  • Text-to-Image: Create stunning images from text prompts using Grok Image AI
  • Image Editing: Edit and transform existing images using Grok Image AI
  • Scenario-Based Generation: Choose from curated creative templates and scenarios
  • Photo Enhancement: AI-powered upscaling, background removal, and restoration

All AI generation is powered by fal.ai infrastructure using xAI's Grok family of models.

Important: Vivoim is an entertainment and creative tool. Results are provided "as is" and are not intended as factual, medical, legal, or professional content.

3. AI Technology & Third-Party Services

3.1 AI Models

Vivoim uses the following AI models via fal.ai:

  • Grok Video (xAI) — Video generation (text-to-video, image-to-video)
  • Grok Image (xAI) — Image generation and editing

3.2 AI Limitations

  • AI-generated content may contain inaccuracies, artifacts, or unexpected results
  • Quality varies based on input prompts, photos, and selected parameters
  • Generation times may vary depending on server load and selected resolution
  • AI models may refuse to generate certain content based on safety filters

3.3 Third-Party Infrastructure

The Service relies on third-party providers including fal.ai (AI processing), Firebase (authentication and storage), Supabase (database), Cloudflare R2 (media storage), and RevenueCat (subscription management). Service availability depends on the uptime of these providers.

4. Disclaimers & Limitations

Entertainment and Creativity Tool Only

  • This app is NOT for medical, legal, scientific, or factual use
  • We make no guarantees about the realism, accuracy, or quality of AI outputs
  • AI results vary significantly based on input quality, prompts, and model behavior
  • Generated content should not be presented as real photography or factual documentation
  • We are not responsible for how users interpret or use AI-generated content

Service Availability

  • The Service is provided on an "as is" and "as available" basis
  • We do not guarantee uninterrupted or error-free service
  • AI model availability depends on third-party providers (fal.ai, xAI)
  • We reserve the right to modify, suspend, or discontinue any feature at any time

5. Eligibility

  • You must be at least 13 years old to use the Service
  • If you are under 18, you represent that you have obtained parental or guardian consent
  • You must comply with all applicable local, state, national, and international laws

6. User Responsibilities

6.1 Content Ownership

  • You must own or have legal rights to any photo you upload
  • You must not upload photos of other people without their explicit consent
  • You are solely responsible for the content you create and share

6.2 Acceptable Use

You agree NOT to use the Service to:

  • Create illegal, harmful, hateful, discriminatory, or threatening content
  • Generate content that infringes on intellectual property rights
  • Create deepfake content intended to deceive, defame, or harm others
  • Impersonate real people in misleading contexts
  • Generate explicit, pornographic, or sexually exploitative content
  • Harass, bully, or intimidate any individual
  • Violate any applicable laws or regulations

6.3 Account Security

  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • You are responsible for all activity that occurs under your account

7. Intellectual Property

7.1 Our Content

The App's source code, design, user interface, AI scenarios, prompt templates, and branding are owned by Vivoim and protected by intellectual property laws.

7.2 Your Content

  • You retain ownership of your original photos and text prompts
  • You are granted a non-exclusive license to use AI-generated content for personal use
  • Pro/Premium subscribers may use generated content for commercial purposes as defined in their subscription plan
  • You grant us a limited license to process your content solely for the purpose of providing the Service

7.3 AI-Generated Content

  • AI-generated videos and images are created using third-party AI models (Grok by xAI)
  • Generated content may be subject to xAI's and fal.ai's usage policies
  • We do not claim ownership of AI-generated content created by users

8. Subscriptions and Credits

8.1 Credit System

  • AI generation requires credits, which are consumed per generation
  • Video generation costs vary by resolution (480p, 720p) and duration
  • Image generation costs a fixed number of credits per image
  • Failed generations are automatically refunded

8.2 Obtaining Credits

  • Free Tier: New users receive complimentary credits to try the Service
  • Subscriptions: Weekly, monthly, or yearly subscription plans provide recurring credits
  • One-Time Purchases: Credit packs can be purchased individually

8.3 Subscription Management

  • Subscriptions are managed via the Apple App Store
  • Payment is charged to your Apple ID account
  • Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
  • Refunds are subject to Apple's refund policies

8.4 Credits Policy

  • Credits are non-transferable between accounts
  • Unused subscription credits do not roll over to the next billing period
  • One-time purchase credits do not expire
  • We reserve the right to modify credit pricing with reasonable notice

9. Content Moderation

  • We employ automated content moderation to prevent misuse
  • AI safety filters may block generation of certain content types
  • We reserve the right to remove content that violates these terms
  • Repeated violations may result in account suspension or termination

10. Data Deletion & Account Termination

10.1 User-Initiated Deletion

  • You can delete individual creations at any time within the app
  • You can request full account deletion via Settings → Account → Delete Account
  • You can also request deletion by emailing umituz9999@gmail.com

10.2 Deletion Timeline

  • Individual creations are deleted immediately upon request
  • Full account deletion removes all data within 30 days
  • Original uploaded photos are processed transiently and never stored permanently

10.3 Termination by Us

  • We may suspend or terminate accounts that violate these terms
  • We may terminate the Service with 30 days advance notice

11. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid for the Service in the preceding 12 months
  • We are not responsible for actions taken by third-party service providers (fal.ai, xAI, etc.)

12. Indemnification

You agree to indemnify and hold harmless Vivoim and its affiliates from any claims, losses, or damages arising from:

  • Your use of the Service
  • Content you create or share using the Service
  • Your violation of these Terms
  • Your violation of any third-party rights

13. Changes to Terms

We may update these Terms from time to time. When we make material changes:

  • We will update the "Last Updated" date at the top of this document
  • We may notify you through the app or via email for significant changes
  • Continued use of the App after updates constitutes acceptance of the new terms
  • If you disagree with changes, you should stop using the Service

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
