Terms of Use for Aria

Welcome to Aria! These Terms of Use ("Terms") govern your access to and use of the Aria AI Companion application ("App", "we", "our", "us"). By downloading, installing, or using Aria, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the App.

1. Age Requirement

You must be at least 17 years old to use Aria.

Aria may contain mature themes, romantic roleplay, and emotionally intimate conversations. By using the App, you confirm that you are 17 years of age or older. If we learn that a user is under 17, we will terminate their account and delete their data.

2. Account & Authentication

Aria assigns you an anonymous account automatically when you first open the App. You may optionally create a full account with an email/password or by signing in with Google.
You are responsible for maintaining the security of your account credentials.
You must not share your account with others or allow others to access your account.
You are responsible for all activity that occurs under your account.
Notify us at umituz9999@gmail.com if you suspect unauthorized access to your account.

3. User Conduct

By using Aria, you agree NOT to:

❌ Use the App for any illegal, harmful, or fraudulent purpose
❌ Attempt to reverse engineer, decompile, or disassemble the App or its AI systems
❌ Bypass, circumvent, or abuse rate limits, credit systems, or security measures
❌ Use the App to generate, distribute, or promote illegal content
❌ Harass, threaten, or harm others using the App
❌ Attempt to extract, scrape, or harvest conversation data or AI model outputs for commercial use
❌ Create multiple accounts to circumvent account restrictions or free trial limits
❌ Interfere with or disrupt the App's servers, networks, or infrastructure
❌ Impersonate any person or entity, or misrepresent your affiliation

4. AI Companion Disclaimer

Aria uses advanced AI technology (powered by Google Gemini) to generate companion responses. By using the App, you acknowledge and agree that:

AI companions are fictional — They are software-generated characters and do not have real feelings, consciousness, physical presence, or genuine relationships.
Responses are automated — AI responses are generated automatically and may occasionally be inaccurate, unexpected, or inconsistent.
Not professional advice — AI-generated content is for entertainment and companionship purposes only and does NOT constitute professional medical, psychological, legal, financial, or therapeutic advice.
No real relationship — Your interactions with AI companions do not create any real-world relationship, obligation, or legal status.
Content variation — AI responses may vary and we cannot guarantee specific response quality, style, or content at all times.

If you are experiencing a mental health crisis or emergency, please contact a qualified mental health professional or emergency services immediately.

5. Credits & In-App Purchases

Credits (In-App Currency)

Aria uses a virtual currency called Credits to send messages and interact with AI companions. 1 credit = 1 AI message. Sending gifts or unlocking special moments may cost additional credits.
Credits have no real-world monetary value and cannot be exchanged for real money, transferred to other users, or redeemed outside the App.
Credits are purchased through credit packages (weekly, monthly, or yearly plans) and expire upon account deletion.

Purchased Credits & In-App Items

In-app purchases are processed by RevenueCat and the Apple App Store.
All purchases are final and non-refundable, except as required by applicable law or Apple App Store policies.
Unused credits are non-transferable and will be lost if your account is deleted or terminated.
We reserve the right to modify credit pricing or package amounts at any time with reasonable notice.
To restore previously purchased credits on a new device, use the "Restore Purchases" option in the App.

6. Privacy

Your use of Aria is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in our Privacy Policy.

7. Intellectual Property

The App, including all content, design, AI systems, personas, and technology, is owned by or licensed to Ümit Uz and is protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
You may not copy, modify, distribute, sell, or lease any part of the App or its content without our written permission.
Content you create (e.g., custom persona names, descriptions) remains yours, but you grant us a license to store and process it to provide the service.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to:

Warranties of merchantability or fitness for a particular purpose
Guarantees of uninterrupted, error-free, or secure service
Guarantees regarding the accuracy, reliability, or quality of AI-generated content

We do not warrant that the App will meet your specific requirements or expectations.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Ümit Uz and their affiliates shall not be liable for any:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, goodwill, or other intangible losses
Damages resulting from your use of or inability to use the App
Damages resulting from unauthorized access to or alteration of your data

Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or permanently terminate your account at any time, without notice, if:

You violate these Terms
Your use poses a risk to other users or the App's infrastructure
We are required to do so by law

Upon termination, your right to use the App ceases immediately. You may delete your own account at any time via Settings → Delete All Data in the App.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Turkey (or the jurisdiction where Umit Uzun operates), without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved through good-faith negotiation first. If unresolved, disputes may be submitted to the competent courts of the applicable jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. When we make changes:

We will update the "Last Updated" date at the top of this document
We may notify registered users of significant changes via email
Continued use of the App after changes constitutes your acceptance of the updated Terms

We encourage you to review these Terms periodically.
